Terms Of Sales
1. All our sales are C.O.D. or cash in advance, unless credit arrangements have been made. A month carrying charge of 1 1/2% (annual percentage of 18%) will be added to all past due balances. Our prices do not include sales tax. State Law requires that we collect Sales tax on all sales, unless a signed tax number card is in our files. All prices are F.O.B. at our farm and all sales are final. 2. A 25% deposit is required for orders to be held for future delivery or pickup, accompanied with an agreed delivery date. If the terms of the agreement are not met, the deposit will be forfeited. 3. We give no warranty, express or implied, as to the productiveness or life of the stock we sell and will not be responsible for the result secured on transplanting. All stock is guaranteed to be in good condition at the time of pick-up, but we assume no responsibility after such stock leaves our farm. 4. All shipments travel at risk and expense of purchaser, our stock is loaded with the greatest care, and therefore our responsibility ends upon delivery in good condition to the carrier. Your carrier is responsible to bring suitable covering, ropes, etc. to assure a safe transportation. Claims for damage to material during shipping must be filed by the customer with the carrier. 5. In the event it becomes necessary to institute action for collection of amount on any unpaid balance, purchaser agrees to pay all costs of collection including attorney’s fees in the trial court an all appellate courts and interests. Purchaser agrees that any lawsuit brought by the seller in the trial courts of Dade County, Florida. 6. On a partial pick up the customer will pay in full for each pick up and the deposit will be applied to last pick up. 7. Restock fee for orders that are pulled from stock and not picked up the customer will lose deposit to cover labor cost of restocking plant material. |
